Not sure about the legalities, but bad_wolf_bitch says that under California Law, some of LJ's actions are illegal. Worth a look for the more fandom-inclined.

There's apparently a fairly large security hole in that whole permanently suspending users thing. It doesn't seem like it at first because pondy is one of the fan artists but say the suspended account in question belonged to a known sex offender who'd misled minors and was on the flist of said minors.
